Feb. 16, 1978 THE 16B 1 9D 11 12Bm 7D IV Husband not in marriage, band NEW ORLEANS (P)-A huslegally does not have the sole say in handling a couple's property, a state judge has ruled in declaring unconstitutional Louisiana's unique "head and master" law. The law, passed in the late 1700s, states: "The husband is the head and master of the partnership or community of gains. He administers its effects, disposes of the revenue that they produce, and may alienate them by an onerous title, without the consent and permission of his wife." Not so, ruled Civil District Judge Gerald Federoff in a suit brought by Corpus Christi Parish Credit Union against Selina Martin and Lawrence Joseph Martin of New Orleans. "In these times there is utterly MINNEAPOLIS STAR I 1Y 'loan' ruler judge rules no justification for the state to grant arbitrarily to the husband the sole administration of property legally owned in common, and in fact as often as not actually produced by the joint earnings of husband and wife," the judge said.

Martin had signed a mortgage in 1974, despite his wife's protests, as collateral for a $5,000 1 loan he took out for his mother. Martin was then without a job and his wife was the family breadwinner. Mrs. Martin, since divorced from Martin, was told by the loan company that her consent was not necessary to make the note legal. When no payments were made on the loan, the company moved to seize the home.
